Lasting powers of attorney: Fiona Smith comments in The Times

Private Client partner, Fiona Smith, provided comment for an article discussing lasting powers of attorney (LPAs) in The Times.

The article, entitled ‘Powers of attorney can transform loving kids into crocodiles’, discusses the increasing popularity of LPAs and their potential for misuse and exploitation.

Fiona helps clarify the rules surrounding LPAs and the responsibilities of the attorney, stating that: “The Mental Capacity Act 2005 provides that anything done, or any decision made, on behalf of a person who lacks capacity must be in their best interests. The attorney must also abide by any limitations the donor put in the LPA.”
